It is an agreement for health care practitioner (either an individual or an organization). A patient his/her representative searching for HCP through the Doctor Bazaar app.

  • a) Website: - users – This agreement is followed by users both registered users and unregistered user as well as “H.C.P.S.”. When you download a access our app or website for the use of the services them you all-ready bounded by our agreement. If you want to ask any question regarding agreement, you can contact us freely. This agreement is valid both in written and oral form if you are communicated by us or our representative. This agreement is governed by our Indian law including the Indian Contract Act, 1872 and the Indian Information Technology Act, 2000. It also covers the Sensitive Personal Information Rules, 2011 (The SPI Rules) and Indian Technology Act, 2021 (The I.G. Act). Practitioners on search result may vary from time to time. The listing of practitioners will be based on automated compilation including input made by the users, their comments, and feedback. These factors may change from time to time to improve the listing of the practitioner on the website.
  • C+. Terms of Use Applicable to All Users Other Than Practitioners The terms used in this class [C] apply only for users other than practitioners. C1. Users’ account and data privacy. C2. Doctor Bazaar shall not be responsible, in any manner, for the authenticity of the personal information or sensitive personal data or information supplied by the user to Doctor Bazaar or to any other person acting on behalf of Doctor Bazaar. C17. The users are responsible for maintaining the confidentiality of the user’s account, access information, and password of the user as registered on the website. The user shall be responsible for all usage of the user’s account and password, whether or not authorized by the user. The user shall immediately notify Doctor Bazaar of any actual or suspected unauthorized use of the user’s account or password. Although Doctor Bazaar will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Doctor Bazaar or such other parties as the case may be due to any unauthorized use of your account. C18. If a user provides any information that is untrue, inaccurate, not current or incomplete (or if Doctor Bazaar has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete), Doctor Bazaar has the right to discontinue the services to the user at its sole discretion.
  • D. Book Appointment D1. Doctor Bazaar enables users to connect with practitioners through website i.e., app book facility that allows users to book appointments through the website i.e., Doctor Bazaar app. D2. Doctor Bazaar will ensure users to provide confirm appointment on the book facility. Doctor Bazaar has no liability if such an appointment is later cancelled by the practitioner or the same practitioner. If the user decides to engage with a practitioner or the same practitioner, it was decided to engage with a practitioner to seek medical services. It is the own risk of users. D3. Without prejudice to the generality of the above, Doctor Bazaar is not involved in providing any healthcare or medical advice or diagnosis, and it is not responsible for any interaction between user and practitioner. Users understand and agree that Doctor Bazaar will not be liable for: D3.1. Users’ interactions and associated issues user has with the practitioners. D3.2. The ability or intent of the practitioner(s), or the lack of it, in fulfilling their obligations towards users. *D3.3* Any wrong medication or quality of treatment being given by the Practitioner(s) or any medical negligence on part of the Practitioner(s). *D3.4* Inappropriate treatment or similar difficulties or any type of inconvenience suffered by the users due to failaaure on the part of the Practitioner to provide agreed services. *D3.5* Any misconduct or inappropriate behavior by the Practitioner or the Practitioner staff. *D3.6* Cancellation or inappropriate behavior by the *D3.7* Cancellation or no-show by the practitioner or rescheduling of booked appointment or any variation in the fees charged. Users are allowed to provide feedback by their personal experiences with the HCPs. Users shall ensure with applicable law. Doctor Bazaar is not obliged to act in such manner as may be required to give effect to the content of users feedback. In the case of Patient-No-Show (P.N.S) (defined below), where the users does not show up a concerned Practitioner clinic. *D3.8* Patient-No-Show (P.N.S) for the purposes of these Terms and conditions is defined as any instance where a user, who booked an appointment on the website using the book. Appointment facility, has not turned up for the appointment without canceling, rescheduling the practitioner in advance about the same. For not showing up Doctor Bazaar not take any action as the Indian rule.

E *CANCELATION AND REFUND POLICY* In the even that, the practitioner with whom User has booked a paid appointment via the website, has not been able to meet the user will need to write mail within five(5) days from the occurrence of such event. On which case, the convenience fee amount as mentioned on the website will be refund to the users within the next (5) five to (6) or six working days. The original mode of payment done by the user while booking. On case where the user, does not show up for the appointment booked with a Practitioner, without canceling the appointment beforehand, the amount will not be refund. The cancellation of appointment of the doctor whose appointment are allowed only at least 48 hours before the date and time of the scheduled appointment. You can not cancel an appointment booked with a doctor that has been scheduled at least a day after the current day. Neither an appointment can be cancelled on the date of the appointment. You would not be entitled to complete refund even if you have cancelled before hand. Users will not be entitled for any refund in case where the Practitioner is unable to meet the user at the exact time of the scheduled appointment time and user is required to wait. Irrespective of the fact whether the user is required to wait or choose to not obtain the services from the said Practitioner.

There are some content like text, data graphics, image, information, Suggestions, guidance and other material, available on the website (including information provided in direction, response to your question or postings) may be provided by individuals in the medical profession. The provision of such information does not create a licensed medical profession / Patient relationship, between Doctor Bazaar and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition, but is only provided to assist you with locating appropriate medical care from a qualified practitioner. representations or warranties, whether expressed or implied with respect to professional qualifications, Quality of work, expertise or other information provided on the website. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information. The services are not intended to be a substitute for getting in touch with emergency healthcare. If you are user facing a medical emergency (either on your or a another person's behalf) please contact an Ambulance Service or Hospital directly

Records Doctor Bazaar has given you a free health facility called 'Records' on its mobile application. Information available in your Records are of two types: A. *User-created*: Users create and upload information generated during your interaction with the Doctor Bazaar ecosystem, i.e., appointments, medicine orders placed by you. B. *Practice-created*: Health records generated by your interaction with a practitioner who uses Doctor Bazaar's services and software. Your records are only created by you and are accepted on these terms. Any Practice-created Health Records are provided on an "as-is" basis at the sole intent, risk, and responsibility of the practitioner and Doctor Bazaar does not validate the said information. You can contact the relevant practitioner in case you wish to point out any discrepancies or add, delete, or modify the health record in any manner. The Health Records are given by you on an "as-is" basis. Though we maintain the highest level of services availability, Doctor Bazaar is not liable for any interruption caused by your access to the services. The reminders given to you are only a supplementary basis to perform your activities as prescribed by your practitioner. Doctor Bazaar refers to your prescription before taking any medication. Doctor Bazaar is not responsible for reminders not being delivered late or incorrectly. If you do not wish to receive the reminder, you can switch it off through the Doctor Bazaar app. It is your responsibility to keep your correct mobile number and email ID updated in the records. Doctor Bazaar is not responsible for any loss or inconvenience caused due to a failure in updating the contact details with us. You should soon inform Doctor Bazaar of any unauthorized use or access. You will take full responsibility to obtain prior consent from your dependent, and you have the right to share, upload, and publish any sensitive personal information of your and your dependent. Doctor Bazaar is against any such claims or liabilities arising out of unauthorized use of such information. If you want to delete your records, you should connect with the service support team of Doctor Bazaar. Health records stored by your practitioners will continue to be stored in their respective account. You may lose your "User created" record if the data is not synced with the server. You may not be able to access your health records due to security reasons. Doctor Bazaar is not take responsibility of Health Records are not delivered to you. The Health Records are shared with the phone numbers that are provided by your Practitioner. Doctor Bazaar is not responsible for adding the Health Records with incorrect numbers if those incorrect numbers are provided by the Practitioner. Doctor Bazaar is not responsible or liable for any content, fact, Health Records, medical deduction or the language used in your Health Records whatsoever. Your Practitioner is solely responsible and liable for your Health Records and any information provided to us including but not limited to the content in them. Doctor Bazaar has the ability in its sole discretion to retract Health Records without any prior notice if they are found to be shared incorrectly, or inadvertently. Doctor Bazaar will follow the law of land in case of any constitutional court or jurisdiction mandates to share the Health Records for any reason. Doctor Bazaar You agree and acknowledge that Doctor Bazaar may need to access the Health Record for cases such as any technical or operational issue of the End User in access or ownership of Records.

Property Rights Doctor Bazaar respect property rights of others and we respect the same from you. You the website, user content, HCP content and Doctor Bazaar are protected by applicable intellectual property law of India. All intellectual property in and to the website and software, techniques, processes used in connection with the website belong to Doctor Bazaar.
